Terms and Conditions
Cascade Cuts accepts cash, check, and credit cards. Open accounts are payable 30 days from the date of invoice. Overdue accounts are subject to a finance charge of 1.5% per month (18% annually). If an account ages over 30 days with no attempt to pay, further deliveries may be on a COD basis. There is a $25 NSF fee for all returned checks. If the purchaser fails to fulfill the terms of the sale, Cascade Cuts reserves the right to either mandate cash on delivery or cancel the order. If an account ages over 60 days with no attempt to pay, then the account may be turned over to collections. The purchaser agrees to pay all collection costs.
ORDERING
All orders, changes and cancellations must be submitted and/or confirmed in writing. It is the buyer’s responsibility to verify the order.
ORDER FULFILLMENT
All orders are subject to stock on hand at the time of order assembly and delivery. Please note that plant availability is unpredictable and ever-changing. To get your order to you in a timely manner, sometimes substitutions are required. Cascade Cuts reserves the right to make reasonable color, size and stock type substitutions based on availability. We will always do our best to substitute the same color and characteristics. In the event of shortages, orders may be refunded and reduced. Since survivability depends on factors beyond our control, we do not guarantee plants to live after they have been accepted. Any stock received in error or in unsatisfactory condition must be reported, in writing, within two (2) business days. It is the customers responsibility to arrange for Cascade Cuts to pick-up or dispose of unsatisfactory/rejected plants. At no time will Cascade Cuts be responsible for more than the purchase price. Claims that lack proper documentation or are not submitted within two (2) business days may not be honored.
DELIVERY
Cascade Cuts utilizes and provides their own delivery service. However, we reserve the right to use third-party shipping services, if appropriate. The purchaser agrees to pay for all shipping costs, nursery-provided, or third-party. Shipping rates are based on volume, destination, and distance. Exact costs are not known until the order is delivered, and will be invoiced to the customer. Delivery costs may be subject to distance fees, tolls, ferry fees, etc. Delivery and shipping costs are subject to change at any time.
ORDER CANCELLATION
All cancellations must be submitted and/or confirmed in writing. Orders cancelled after assembly may be subject to a re-stocking/cancellation fee.
SALES TAX
Cascade Cuts may be required to collect Washington State sales tax, unless supplied with a valid and current Resale Certificate.
Cascade Cuts reserves the right to delay, change or cancel any order, in part or in whole, due to any circumstances beyond our control, including, but not limited to: labor shortages, natural disaster, fire, frost, flood, drought, disease, pests, casualty, errors in stock availability or count, plant spoilage or acts of nature.
